Clarisan purchase terms
These terms govern the purchase of Clarisan licenses through the Payment Links managed by Stripe Managed Payments. They are complemented by the Clarisan License and the Withdrawal information, both versioned together with this document.

Purchase terms
1. Provider identity
Fernando Herrera Monroy ("the provider"), Tax ID (NIF) 32089209T, registered address Calle Turquía 1, 11406 Jerez de la Frontera, phone 600731819, email contacto@fherrera.dev, is the owner and developer of Clarisan and grants the license of use described in this document. The provider offers product-level support under the terms below.
2. What Clarisan is
Clarisan is a premium website template for healthcare practices and clinics (psychology, physiotherapy, dental), available in three presets: Psychology, Physio, and Dental.
3. Digital nature of the delivery
Clarisan is digital content not supplied on a tangible medium. It is delivered as a downloadable ZIP file, together with usage documentation.
4. Technical requirements
Customizing and deploying Clarisan requires: Node.js ≥ 22.12, npm, a terminal, and basic knowledge of editing Astro, TypeScript, and Markdown code. The buyer supplies their own content, images, business data, legal text adapted to their activity, hosting, and the configuration of any third-party services they choose to use (for example Web3Forms or an embedded map).
5. Main features
Built with Astro 7, Tailwind CSS 4, and TypeScript. Static site, no backend of its own.
6. Language per installation
Each Clarisan installation is delivered in a single language (Spanish or English), fixed at installation time. Clarisan does not include a runtime language switcher.
7. Presets
Three presets are available: Psychology, Physio, and Dental. The buyer chooses one as the base for their project.
8. Single license
- 49 USD base price.
- 1 project (own or a client's).
- Commercial use and customization of code, design, and content.
- Indefinite license as long as these terms are respected.
- 6 months of email support from the purchase date.
- 12 months of general updates from the purchase date.
- No right to redistribute, resell, or sublicense the template.
9. Extended / Agency license
- 149 USD base price.
- Up to 10 projects (own and/or client projects).
- Same customization possibilities as the Single license.
- Indefinite license as long as these terms are respected.
- 6 months of email support from the purchase date.
- 12 months of general updates from the purchase date.
- No right to redistribute, resell, or sublicense the template.
10. Duration
Both licenses are indefinite in duration, subject to compliance with these terms. "Indefinite" refers exclusively to the duration of the license of use — it does not imply indefinite support or indefinite updates, which are subject to the commercial periods in sections 8 and 9.
11. Permitted projects
Depending on the license purchased (sections 8 and 9), Clarisan may be used on the buyer's own projects or on projects developed for the buyer's clients.
12. Commercial use
Both licenses allow commercial use of the resulting website.
13. Customization
The buyer may freely modify Clarisan's code, design, and content within the scope of their license.
14. Delivery to the end client
The buyer may deliver the finished project (based on Clarisan and already customized) to their end client, within the number of projects allowed by their license.
15. No redistribution
Redistributing, reselling, or sublicensing the Clarisan template itself — as a product, boilerplate, or starter — as well as sharing the ZIP file in a way that allows its use without the corresponding license, is prohibited.
16. Price
Single license: 49 USD. Extended / Agency license: 149 USD. Base prices before applicable taxes.
17. Taxes
Applicable taxes depend on the buyer's location and tax status. Stripe shows the final total, including any applicable taxes, before payment is confirmed.
18. Purchase process
The purchase is made through a Payment Link managed by Stripe Managed Payments. The buyer completes checkout hosted by Stripe, which generates a Checkout Session tied to the license chosen.
19. Stripe Managed Payments / Link
Stripe Managed Payments / Link handles checkout, transaction processing, certain indirect taxes according to its coverage, fraud prevention, dispute handling, and purchase receipts. Stripe/Link appears to the buyer as the Merchant of Record for the transaction. The provider (section 1) is the owner and licensor of Clarisan and provides product-level support — the provider is not the Merchant of Record for the payment transaction.
20. Digital delivery
After payment, the Clarisan file is delivered through a protected route on the provider's website, not through a permanent public link. Access to the download requires validating the license issued.
21. License issuance
The Clarisan license is issued and managed automatically after payment is confirmed, according to the license type purchased.
22. Support
6 months of email support from the purchase date. This includes reasonable questions about installation, basic configuration, and how included features work, as well as reporting bugs. It does not include custom development, specific customization, configuration of third-party infrastructure, content adaptation, maintenance of the buyer's already-customized project, errors caused solely by the buyer's own modifications, or third-party services unrelated to Clarisan. Support does not include a service-level agreement (SLA) or a guaranteed response time.
23. Updates
12 months of general updates from the purchase date. Lifetime updates are not offered. This commercial period does not limit updates that become legally necessary to maintain the digital content's conformity for a consumer, under section 29.
24. Consumers
Clarisan may be purchased by consumers. These terms do not limit any mandatory rights that consumer-protection law grants to the buyer.
25. Right of withdrawal
If the buyer is a consumer, they have a 14 calendar-day period from contracting to withdraw from the contract, unless that right has been validly lost under section 27. The procedure, the consent wording for immediate supply, and the model withdrawal form are set out in the "Withdrawal information" document associated with this version of these terms.
26. Start of supply
Supply of the digital content (the actual file download) does not begin automatically after payment. It begins only when the buyer accesses the protected download route and, if still within the withdrawal period, gives the specific consent described in the withdrawal document.
27. Valid loss of the right of withdrawal
The right of withdrawal is lost when the buyer expressly requests that supply begin immediately, acknowledges that loss, and supply actually begins, under the conditions described in the withdrawal document. If the buyer does not give that consent, they keep their right of withdrawal and may access the content once the ordinary period has elapsed, per that same withdrawal document.
28. Refunds
Outside of cases where a legal right of withdrawal, a lack of conformity of the digital content, or another legal ground for reimbursement applies, no general commercial money-back guarantee is offered. Requests and transactions are also subject to the applicable Stripe Managed Payments / Link regime, which may handle certain refunds within its own operational process.
29. Legal conformity
Clarisan must match what was agreed at the time of delivery. If the digital content is not conforming, a buyer who is a consumer has the mandatory rights that applicable law grants against lack of conformity, independent of the commercial periods for support (section 22) and updates (section 23).
30. Updates required for conformity
When an update is legally necessary to maintain the conformity of digital content supplied to a consumer, that update is not limited by the 12-month commercial period in section 23.
31. Intellectual property
Clarisan, its source code, design, and documentation are the property of the provider. The license grants a right of use under this document's terms; it does not transfer ownership of the template's intellectual property.
32. Substantial breach and termination
The license may be terminated only for a substantial breach of these terms by the buyer (in particular, the redistribution, resale, or sublicensing prohibited in section 15). Termination does not operate automatically for any minor breach, and does not deprive the buyer of any mandatory rights they may hold.
33. Liability
Except as set out in section 34, the provider's liability is limited, to the maximum extent permitted by applicable law, to what reasonably follows from using Clarisan in accordance with its documentation. This limitation does not exclude the mandatory rights and warranties granted to consumers, including the legal conformity of the digital content.
34. Warranty
No absolute "as is / no warranty" commercial guarantee is offered. Statutory conformity rights, mandatory warranties, and non-waivable rights owed to the buyer under applicable law are expressly preserved.

Support inquiries and any communication related to this purchase may be sent to contacto@fherrera.dev.
36. Complaints
The buyer may file a complaint directly with the provider at the address in section 35, or through the consumer-protection channels that apply to them under their own applicable law.
37. Contract languages
These terms are available in Spanish and English. In case of discrepancy for a purchase made from the Spanish version of the site, the Spanish text prevails; for a purchase made from the English version, the English text prevails, unless applicable law requires otherwise.
38. Correcting errors before ordering
Before confirming payment, the buyer can review and correct their order details within the checkout hosted by Stripe, using the mechanisms it provides.
39. Contract archive and versioning
Each purchase is tied to a specific version of these terms, of the license, and of the withdrawal document, identified by its version date. Once published, a version is not modified retroactively: a material change results in a new version, and past purchases keep the version in force at the time of contracting.
40. Access to the applicable version
The version of these terms applicable to a given purchase is the one in force at the time of contracting, and is kept together with that purchase's evidence.
41. Governing law
These terms are governed by Spanish law, without prejudice to any mandatory consumer-protection provisions that may apply to the buyer based on their habitual residence, which these terms cannot override.
This document is complemented by the Clarisan License and the Withdrawal information, versioned independently.
Clarisan license
This license is granted together with the purchase of Clarisan through one of the Payment Links managed by Stripe Managed Payments, and complements the Clarisan Purchase Terms (same version, see content/legal/clarisan/manifest.ts).
Scope by purchased license
Single (49 USD) — 1 project, own or a client's.
Extended / Agency (149 USD) — up to 10 projects, own and/or client projects.
What either license allows
- Commercial use of the resulting website.
- Modifying Clarisan's code, design, and content.
- Delivering the finished project to an end client, within the number of projects allowed.
- Indefinite license as long as these terms are respected.
- 6 months of email support from the purchase date.
- 12 months of general updates from the purchase date.
What either license prohibits
- Redistributing the Clarisan template as a product, boilerplate, or starter.
- Reselling or sublicensing the template itself (not the already-customized project delivered to an end client, which is allowed under the section above).
- Sharing the ZIP file in a way that allows its use without the corresponding license.
Duration and termination
The license is indefinite in duration. It may be terminated only for a substantial breach of these terms — in particular, the prohibited redistribution, resale, or sublicensing — and not automatically for any minor breach. Termination does not deprive the license holder of any mandatory rights they hold as a consumer.
Warranty and liability
No absolute "as is / no warranty" commercial guarantee is offered. Statutory conformity rights, mandatory warranties, and non-waivable rights owed to the buyer under applicable law are preserved, on the same terms described in the Clarisan Purchase Terms.
Intellectual property
Clarisan, its source code, design, and documentation are the property of Fernando Herrera Monroy. This license grants a right of use under the terms above; it does not transfer ownership of the template's intellectual property.
Withdrawal information
This information complements the Clarisan Purchase Terms (same version, see content/legal/clarisan/manifest.ts). It describes the right of withdrawal applicable to buyers who are consumers.
Your right of withdrawal
If you purchase Clarisan as a consumer, you have a 14 calendar-day period from contracting to withdraw from the contract, with no need to justify your decision, unless that right has been validly lost under the terms below.
Why supply doesn't start automatically
Clarisan is digital content not supplied on a tangible medium. The actual file download does not begin at the moment of payment: it only begins when you access the provider's protected download route with your validated license.
Two options within the first 14 days
Option A — Access now. You may request that supply begin immediately, before the withdrawal period ends. To do so, you'll be asked for an express, specific consent — independent of any other acceptance — with the following wording:
"I request that the supply of Clarisan begin immediately, before the 14-day withdrawal period ends, and I understand that once the supply of the digital content begins under the applicable legal conditions, I will lose my right of withdrawal."
If you give that consent and supply actually begins, you lose your right of withdrawal from that point on.
Option B — Keep your right of withdrawal. You may choose not to request immediate supply. In that case the file is not delivered to you yet; you keep your right of withdrawal and can come back later with your license. Once 14 days have passed from contracting, if your purchase and license are still valid, you'll be able to access the download without needing to expressly waive withdrawal.
Neither option is presented as a penalty — both are equally valid ways to use your purchase.
How to exercise withdrawal
Before supply has begun (that is, while you haven't chosen Option A above, or within the period if you haven't yet accessed the download), you can communicate your decision to withdraw using the model form below, or another unambiguous statement, addressed to contacto@fherrera.dev.

Option A's consent wording is the one used, without variation, in the protected download flow.
